When a claim is made against your business one of the Peninsula team will conduct an introductory call to understand the circumstances surrounding the claim. This will usually be within 24-48 hours of the claim being received.
We will contact the claimant’s representative to inform them we are acting on your behalf and all communication is to go through us. We then provide HR or HSW support and assist with conducting and facilitating workplace meetings to represent you and your business.
We also assist with corresponding with the Employment Relations Authority, the Labour Inspectorate, WorkSafe or MBIE and develop documentation.
Most Peninsula clients are members of Peninsula Mutual, a member owned discretionary mutual fund providing financial protection for legal liability and defence costs resulting from an employment relations or health and safety claim.
If early resolution of the claim is not achieved, Peninsula Mutual’s panel law firms may be engaged to protect your business from protracted litigation.
Subject to Peninsula Mutual approving your claim under the PDS, you will then be assigned a professional representative to resolve the dispute. They will help you work through defending or managing the claim to achieve the most cost-effective outcome for you and your business.
Do I still receive support from the Claims Team if I didn’t seek or follow advice before the claim was raised?
Yes, discretionary support for non-covered clients is still provided by the Claims Team, although this support is typically focused on achieving early resolution and depends on the capacity of the team and the type of claim that was raised.
Does the Claims Team operate in the same way as a law firm?
All current permanent Claims Advisers hold degrees in law, and many have practised previously. However, Peninsula is not a practising law firm, and our representation is most-commonly provided under s236 of the Employment Relations Act. Our support in resolving personal grievances is still subjected to absolute privilege under s121 of the Employment Relations Act.
What is Peninsula Mutual and Peninsula Protect?
Most Peninsula New Zealand clients are members of Peninsula Mutual. This is a member owned discretionary mutual. Membership of the Mutual and access to the discretionary product Peninsula Protect is available exclusively to Peninsula clients. Peninsula Protect provides protection for legal liability and defence costs arising from employment relations and Health and Safety claims. As a Peninsula client you can choose to become a Peninsula Mutual member. The terms and conditions attached to membership of, and coverage for claims made against an employer by, Peninsula Mutual are governed by the Product Disclosure Statement. Peninsula Mutual holds an Australian Financial Services Licence (AFSL No. 544232). Peninsula Group NZ Limited has been appointed to distribute the discretionary risk product Peninsula Protect in New Zealand.
